BUYER TERMS AND DISCLAIMER
All purchases made through the Island Wardrobe Marketplace are governed by these
Terms. By registering as a Buyer and using the Marketplace, you agree to the terms set
out herein.
1. Eligibility as Buyer
Buyers must be at least eighteen (18) years old and must provide accurate registration and payment information. Buyers must hold a local bank account for the purpose of
purchasing on the platform.
2. Purchases
i. All purchases on the platform are final and only applicable for return or refund should the Seller explicitly allow the same within the description of the listing, unless otherwise required by law.
ii. The total purchase price shall comprise:
• the listed sale price of the item;
• the applicable Marketplace Service Fee (currently 20% of the listed sale price); and
• the applicable delivery fee.
iii. Island Wardrobe reserves the right to amend its Marketplace Service Fee and delivery
fee from time to time, notice of which will be given to users of the platform.
3. Product Listings
All products are listed and sold by independent Sellers.
Island Wardrobe does not own, inspect, verify or authenticate items listed on the
Marketplace and makes no representation or warranty regarding the ownership,
authenticity, quality, condition or suitability of any listed item.
Each Seller is solely responsible for ensuring that the description, photographs and
condition of the listed item are accurate.
4. Delivery
i. Island Wardrobe facilitates delivery by providing the Buyer's and Seller's contact
information to an independent courier for the sole purpose of collecting and delivering
purchased items.
ii. Where a package is lost due solely to the error of the courier prior to delivery, Island
Wardrobe shall arrange for the appropriate refund.
6. Reviews
Verified Buyers may submit reviews regarding completed purchases.
Island Wardrobe reserves the right to remove any review which is false, misleading,
abusive, offensive, fraudulent or otherwise inconsistent with the integrity of the
Marketplace.
7. Buyer Conduct
Buyers shall not:
i. submit fraudulent orders or payment information;
ii. intentionally damage items before making complaints;
iii. abuse Sellers or Island Wardrobe staff;
iv. misuse the Marketplace or engage in unlawful activity.
Island Wardrobe reserves the right to suspend or terminate Buyer accounts for breaches
of these Terms.
8. Limitation of Liability
Island Wardrobe is not the owner or seller of listed items and shall not be liable for:
i. inaccurate or misleading listings;
ii. counterfeit or stolen goods;
iii. defects in purchased items;
iv. the acts or omissions of any Seller or independent courier; or
v. any indirect or consequential loss arising from the use of the Marketplace, except
where liability cannot lawfully be excluded.
9. Governing Law
For all intents and purposes, these Buyer Terms and Disclaimer shall at all times be governed by the laws of Trinidad and Tobago and any action arising therefrom shall be determined through the local courts.
SELLER TERMS AND DISCLAIMER
All listing and sale of products on Island Wardrobe marketplace is governed by this Seller Agreement. On registration as a seller, you agree to the terms as set out herein.
1. Eligibility as Seller
Registration is free. Sellers must be legally entitled to sell listed goods, be at least 18 years old (or have appropriate legal authority), and provide accurate registration and payment information. All Sellers must possess a local currency bank account held in Trinidad and
Tobago.
2. Seller Obligations
The Seller agrees to:
i. list only goods lawfully owned by the Seller;
ii. provide complete and accurate descriptions which reflect the condition, brand and colour
iii. of the item with accuracy;
iv. upload recent photographs accurately depicting the item;
v. disclose all defects, stains, alterations and wear;
vi. keep listings up to date;
vii. dispatch sold items within seven (7) days of sale;
viii. respond to buyer enquiries within five (5) working days.
3. Product Condition and Standards
Items must be clean, safe, accurately categorised and free from undisclosed defects.
Counterfeit, replica, illegal, hazardous, stolen or prohibited items must not be listed.
4. Pricing Structure and Intervention
The Seller determines the selling price and may review the same at their own discretion.
Island Wardrobe does not make recommendation nor intervene as regards pricing.
5. Marketplace Fees
The Buyer pays the listed sale price, a Marketplace Service Fee (currently 20% of the listed
sale price) and the applicable delivery fee. Island Wardrobe retains the Marketplace Service
Fee. Fee structures may be amended upon reasonable notice.
6. Payment
Island Wardrobe collects payment from the Buyer. Funds are held until confirmed delivery. Following successful delivery, Island Wardrobe releases the Seller's sale proceeds. Payment may be delayed where fraud, disputes or chargebacks arise.
7. Delivery
The Seller shall package items securely and make them available for courier collection
within five (5) days. The Seller authorises Island Wardrobe to provide the Seller's and
Buyer's contact details to the courier solely for collection and delivery purposes.
8. Reviews
Verified buyers may leave reviews. Reviews may influence seller visibility. Fraudulent or
abusive reviews may be removed.
9. Suspension and Termination Island Wardrobe may suspend, remove listings or terminate seller accounts for counterfeit goods, repeated misrepresentation, abusive conduct, policy breaches or illegal activity.
10. Limitation of Liability
Island Wardrobe operates solely as a marketplace facilitator and is not the owner or seller of listed items. It is not liable for seller conduct, stolen goods, listing inaccuracies or courier actions except where required by law.
11. Indemnity
The Seller shall indemnify Island Wardrobe against claims, losses, damages, liabilities and costs arising from the Seller's breach of this Agreement, unlawful conduct or infringement of third-party rights. Island Wardrobe takes no liability or responsibility for issues nor damages which may be incurred as a result of breach.
12. Governing Law
For all intents and purposes, this Agreement shall at all times be governed by the laws of Trinidad and Tobago and any action arising therefrom shall be determined through the local courts.
